This question raises issues concerning liability for the offences of ‘causing grievous bodily harm with intent’ and ‘maliciously inflicting grievous bodily harm’ and contrary to sections 18 and 20 of the Offences Against the Person Act 1861, respectively.
And involves the question whether V’s consent to the risk of contracting the infection negatives liability.
Liability for the offence of rape contrary to s 1 of the Sexual Offences Act 2003 and the statutory definition of consent applying to that offence are also considered.
