This recorded lecture – in Q&A format – explains how to structure an answer to a problem question on mistake in the law of contract.

It explains how an operative mistake makes a contract void rather than voidable (and the significance of this) and of the rules relating to the following types of mistake:

  • ‘mutual’ mistakes (where parties are at cross-purposes)
  • ‘unilateral’ mistakes as to terms (where one party has made a mistake as to the subject matter / terms of the proposed contract)
  • ‘common’ mistakes (both parties share a mistaken assumption) as to the existence of the subject matter
  • ‘common’ mistakes (both parties share a mistaken assumption) as to a quality of the subject matter
