The law on breach of confidence has, in recent years, spawned a new and increasingly distinct law on privacy. Drawing heavily on the Human Rights Act 1998, the law now recognises a right to privacy which a few years ago was specifically rejected by the courts. This lecture explains how English law has come to recognise this important right, tracking the cases through which it has developed and describing important developments in the European Court of Human Rights.
